REGULATIONS
ON USING THE WEDDING RING CONFIGURATOR
I. GENERAL PROVISIONS
1.

These Regulations for the use of the wedding ring configurator (hereinafter referred to as the Regulations) define the terms and conditions of using the configurator enabling the creation of personalized wedding ring designs, which is available on the website under the domain http://stelmach.pl.

2.

The Regulations apply to all entities using the Configurator, including natural persons who do not conduct business activity (consumers), natural persons conducting business activity, legal persons and organizational units without legal personality to which the law grants legal capacity.

3.

The provisions of the Regulations may be excluded only by an agreement concluded by the Administrator with the User, made in writing under pain of nullity.

II. DEFINITIONS

For the purposes of the Regulations, the definitions of the following terms used in its content are established:

1)

Administrator – PZ Stelmach Sp. z o.o. with its seat in Opole at ul. Północna 22, 45-805 Opole, entered into the Register of Entrepreneurs of the National Court Register under No.: 0000275847, with a share capital of PLN 2,192,000.00, NIP (Tax ID No.) 7542889545, REGON (Business registry No.) 16011198800000, the registration files of which are kept by the District Court in Opole, 8th Economic Division of the National Court Register;

2)

User – any person or entity visiting the Webpage;

3)

Webpage – webpage run under the domain http://stelmach.pl;

4)

Configurator – a configurator for designing wedding rings available on the Webpage;

5)

Partner/Partners – entity/entities to which the User may turn to in order to place an order for the implementation of the Design;

6)

Design – wedding ring design caried out by the User in the Configurator;

7)

Civil Code – the Act of April 23, 1964, the Civil Code (i.e. Dz. U. of 2020 item 1740 with later amendments).

III. RULES OF USING THE CONFIGURATOR
1.

The Administrator provides the User with a Configurator enabling the creation of an individualized design of the wedding ring tailored to the User's preferences.

2.

Using the wedding ring Configurator is free of charge.

3.

Designing takes place by selecting the following features of the ring from among the variants available in the Configurator:

a.

profile.

b.

dimensions.

c.

precious metal type.

d.

types of grooves and notches.

e.

diamonds.

f.

engraving, including individual engraving, e.g. containing a fingerprint.

4.

After designing the ring, the Configurator will display the User the suggested price of the design implementation at the Partner's. The Administrator reserves that the price presented in the Configurator may differ from the price proposed by the Partner. The price displayed in the Configurator is determined on the day of creating the Design, including the prices of components for that day and the margin applied by the Partners as standard, and these factors may change, which may result in a discrepancy between the price displayed in the Configurator and the price actually offered by Partner. Any discrepancies in the price do not give rise to any claims against the Administrator on the part of the User.

IV. PLACING AN ORDERS
1.

The Configurator is not provided to place orders for the implementation of your Design with the Administrator.

2.

The Configurator is not used to automatically place orders with the Partner via electronic means.

3.

After creating the Design, the User may click the “Order wedding rings” button, then a list of provinces in which the Partner stores are located will be displayed. After the User selects the Province, a list of Partners with their addresses will be displayed. After the User selects a specific Partner, the User will be presented with a summary, i.e., information about the configuration number, i.e., the Design number, as well as the Partner's name and address. Owing to the configuration number, after entering the configuration number into the system, the Partner will have all the information about the Design, which is to be the subject of the order.

4.

The User may download a PDF document containing in particular information about the parameters of the rings, configuration number, Partner's name and address, date of generating the Design, and suggested price.

5.

The use of the Configurator does not create an obligation to conclude a contract regarding the implementation of the Design, neither on the part of the User, nor on the part of the Partner, or the Administrator.

V. LIABILITY OF THE ADMINISTRATOR
1.

The information displayed in the Configurator does not constitute an offer within the meaning of Art. 66 of the Civil Code

2.

The use of the Configurator by the User does not establish any legal relationship between the Administrator and the User related to the implementation of the Design, and thus does not create any obligations for the Administrator in this respect. In particular, the Administrator is not responsible for:

a.

the Partner's refusal to implement the Design.

b.

the terms of the Design implementation offered by the Partner.

c.

implementation of the Design by the Partner, including for non-compliance of the rings with the Design, other defects of the rings, delay in the Design implementation, or other irregularities arising in the course of the Design implementation.

3.

The User should direct any claims arising from the Design implementation against the entity that the implementation has been commissioned to

VI. PROCESSING OF PERSONAL DATA
1.

You are not required to provide any personal data to use the Configurator.

2.

The processing of the User's personal data by the Administrator may take place in connection with the User's activities other than the use of the Configurator, e.g., in the event of reporting errors in the operation of the Configurator in accordance with point VII of the Regulations, whereas, in such situations, the provisions of the Privacy Policy, available at Website, shall apply.

VII. ERROR REPORTING
1.

Any errors in the operation of the Configurator may be reported by the User by e-mail to biuro@stelmach.pl, or by phone at +48 77 54 90 100. Such a message should describe in detail the irregularity found and indicate the date of its occurrence.

2.

The Administrator will immediately proceed to verify the reported issue, and will inform the User about its results by e-mail to the address from which the error report has been sent.

VIII. FINAL PROVISIONS
1.

In the event that any of the provisions of the Regulations turn out to be invalid or ineffective, it does not affect the validity and effectiveness of the remaining provisions.

2.

The rights and obligations arising from the Regulations are governed by Polish law.

3.

In matters not expressly covered by the Regulations, generally applicable provisions of law shall apply.
